Plain English Summary: GoToGoCar is a platform that helps people share car rides between cities and split costs. We connect drivers and riders — we are not a taxi company. You must be 18+, be honest about your ride details, and treat other users respectfully. By using the app, you agree to these terms.

1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and GoToGoCar ("GoToGoCar", "we", "our", or "us"), governing your access to and use of the GoToGoCar mobile application, website at gotogocar.com, and all related services (collectively, the "Platform").

By downloading, installing, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately stop using the Platform and uninstall the application.

These Terms apply to all users of the Platform, including registered users, visitors, drivers, and riders.

2 Definitions

3 Eligibility

To use GoToGoCar, you must:

If you are accessing the Platform on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

By using the Platform, you represent and warrant that you meet all eligibility requirements. GoToGoCar reserves the right to verify eligibility at any time and to refuse access if requirements are not met.

4 Account Registration & Security

4.1 Registration

To access most features of the Platform, you must register an account using a valid Indian mobile phone number. Your account is verified via a one-time password (OTP). You agree to provide accurate, current, and complete information during registration and to keep your profile information updated.

4.2 One Account Per Person

Each individual may only maintain one active account. Creating multiple accounts to circumvent bans, ratings, or platform policies is strictly prohibited and will result in permanent suspension of all associated accounts.

Your profile name, photo, and vehicle details (for Drivers) must be accurate and not misleading. Profile photos must be clear, recent, and show only yourself. Using another person's identity, vehicle, or photo is prohibited and may result in account termination and legal action.

5 Nature of the Platform & Our Role

GoToGoCar is a technology platform only — not a transportation company, taxi aggregator, or cab service.

Drivers and Riders transact entirely with each other. GoToGoCar facilitates the connection and provides safety tools (verification, ratings, in-app chat) but is not a party to any ride arrangement between users.

7 Ride Posting & Booking Rules

7.1 Accuracy of Ride Information

Drivers must post accurate and complete ride information, including:

Posting false or misleading ride information is a serious violation and may result in immediate account suspension.

7.2 Seat Availability

Drivers must not accept more bookings than the actual available seats in their vehicle. Overbooking or accepting bookings with no intention of completing the ride is prohibited.

7.3 Ride Confirmation

A Booking is confirmed only when the Driver accepts the Rider's request through the Platform. At the point of confirmation, both parties are bound by the agreed terms of the ride (route, date, time, price, pickup point).

7.4 Changes to Confirmed Rides

Material changes to a confirmed Ride (e.g., change of date, departure city, or price) must be communicated to all confirmed Riders through the in-app chat immediately. Riders retain the right to cancel without penalty if a material change is made by the Driver after confirmation.

8 Payments, Cost-Sharing & Fees

8.1 Nature of Payments

All monetary transactions on GoToGoCar represent cost-sharing arrangements — a proportional contribution toward fuel, tolls, and incidental travel costs. They are not commercial fares. GoToGoCar is not a payment service provider.

8.2 Platform Commission

GoToGoCar currently charges zero platform commission on rides. This may change in the future, in which case advance notice will be provided as described in Section 20.

8.3 Payment Between Users

Payment arrangements (cash, UPI, or other methods) are agreed directly between Drivers and Riders. GoToGoCar is not a party to these transactions, does not process or hold funds on behalf of users, and is not responsible for payment disputes.

8.4 Disputes

In the event of a payment dispute, users may contact GoToGoCar support for assistance in mediation. GoToGoCar will make reasonable efforts to help but has no obligation to resolve payment disputes or enforce payment between users.

8.5 Pricing Limits

Drivers must not set prices that constitute a commercial profit. GoToGoCar reserves the right to review and flag rides where the per-seat cost appears disproportionate to actual travel expenses, and to suspend accounts that consistently exploit the platform for commercial gain.

9 Cancellations & No-Shows

9.1 Driver Cancellation

Drivers may cancel a confirmed Ride at any time but must notify all confirmed Riders immediately through the Platform. Repeated cancellations without valid reason may result in reduced visibility of ride listings or account suspension.

9.2 Rider Cancellation

Riders may cancel a confirmed Booking at any time through the Platform. It is courteous to cancel as early as possible to allow the Driver to find alternative Riders. No-shows (failing to appear at the pickup point without cancelling) negatively impact community ratings.

9.3 No Guaranteed Refunds

Since GoToGoCar does not process payments, refund arrangements for prepaid cost-sharing must be negotiated directly between the Driver and Rider. GoToGoCar has no liability for any amounts paid by Riders to Drivers.

9.4 Cancellation Impact on Ratings

Late cancellations and no-shows are reflected in a user's community rating and may affect their ability to book or post rides in the future.

Violations of this Section may result in immediate account suspension or permanent termination, removal of your ride listings, reporting to law enforcement where applicable, and civil or criminal liability.

11 Ratings, Reviews & Community Standards

11.1 Two-Way Rating System

After each completed ride, both Drivers and Riders may rate each other on a 1–5 star scale and leave a written review. This rating system is fundamental to platform safety and trust.

Ratings must reflect genuine experiences. The following are prohibited:

If you believe a rating or review violates these Terms (e.g., is false or defamatory), you may report it to support@gotogocar.com. GoToGoCar will review reports and may remove content that clearly violates these Terms, but has no obligation to remove ratings that reflect a user's genuine experience.

11.4 Low Ratings

GoToGoCar reserves the right to restrict or suspend accounts with consistently low ratings that indicate a pattern of poor conduct, as determined at our sole discretion.

12 Intellectual Property

12.1 GoToGoCar's IP

The Platform — including its design, code, branding, logo, trademarks, text, graphics, and all content created by GoToGoCar — is owned by or licensed to GoToGoCar and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works of any GoToGoCar content without our prior written consent.

12.2 Limited Licence to You

GoToGoCar grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial purposes in accordance with these Terms. This licence terminates automatically upon account termination or violation of these Terms.

12.3 Feedback

If you provide feedback, suggestions, or ideas about the Platform, you grant GoToGoCar a perpetual, irrevocable, royalty-free, worldwide licence to use and implement that feedback without any obligation to you.

13 User-Generated Content

You retain ownership of content you submit to the Platform (profile photo, ride descriptions, chat messages, reviews). By submitting content, you grant GoToGoCar a non-exclusive, royalty-free, worldwide licence to use, store, display, and distribute that content solely for the purpose of operating and improving the Platform.

You represent and warrant that:

GoToGoCar reserves the right to remove any user-generated content that violates these Terms or applicable law, at any time and without notice.

14 Disclaimers & Warranties

The Platform is provided "as is" and "as available" without any warranty of any kind, express or implied.

To the fullest extent permitted by applicable law, GoToGoCar expressly disclaims all warranties, including but not limited to:

You use the Platform and participate in any ride entirely at your own risk. Nothing in this clause affects any rights you may have under applicable consumer protection laws in India.

15 Limitation of Liability

To the maximum extent permitted by applicable Indian law:

15.1 No Liability for User Conduct

GoToGoCar shall not be liable for any harm, loss, injury, or damage caused by the actions or omissions of any Driver, Rider, or other user of the Platform, including but not limited to road accidents, physical harm, theft, or fraud.

15.2 No Liability for Indirect Losses

GoToGoCar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of data, loss of goodwill, or any intangible losses arising from:

To the extent GoToGoCar is found liable for any claim arising from these Terms or your use of the Platform, our total aggregate liability shall not exceed ₹1,000 (Indian Rupees One Thousand) or the amount you paid to GoToGoCar in the three months preceding the claim, whichever is greater.

15.4 Essential Basis

You acknowledge that the limitations of liability in this Section reflect a reasonable and fair allocation of risk between GoToGoCar and users, and are an essential basis of the bargain between us. GoToGoCar would not provide the Platform without these limitations.

16 Indemnification

You agree to defend, indemnify, and hold harmless GoToGoCar, its founders, officers, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

GoToGoCar reserves the right to assume exclusive control of any matter subject to indemnification by you, at your expense. You agree not to settle any such matter without GoToGoCar's prior written consent.

17 Account Suspension & Termination

GoToGoCar may suspend or permanently terminate your account, with or without notice, for:

You may terminate your account at any time through the in-app "Delete Account" option or by visiting gotogocar.com/delete-account.html. Deletion is permanent. Sections of these Terms that by their nature should survive termination (including Sections 14, 15, 16, and 19) shall remain in full force after termination.

18 Dispute Resolution

18.1 Between Users

GoToGoCar is not obligated to mediate disputes between users. Where a dispute arises between a Driver and Rider (relating to a ride, payment, conduct, or otherwise), we encourage users to first attempt to resolve it directly through in-app communication.

If direct resolution fails, you may contact GoToGoCar support at support@gotogocar.com. We will make reasonable efforts to assist but are not legally obligated to resolve inter-user disputes.

18.2 Against GoToGoCar

Before initiating any formal legal proceedings against GoToGoCar, you agree to first contact us at support@gotogocar.com and give us 30 days to attempt to resolve the dispute informally. This does not affect your right to seek urgent injunctive relief.

18.3 Grievance Redressal

For formal complaints, please refer to our Grievance Officer as detailed in Section 21. Under Indian law, we are required to acknowledge complaints within 24 hours and resolve them within 30 days.

19 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts located in Hyderabad, Telangana, India.

You irrevocably submit to the personal jurisdiction of such courts and waive any objection to the laying of venue of any proceedings in those courts.

20 Changes to These Terms

GoToGoCar reserves the right to modify these Terms at any time. When we make material changes, we will:

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Platform and delete your account before the effective date.

We recommend reviewing these Terms periodically. The current version is always available at gotogocar.com/terms.html.

21 Grievance Officer

In accordance with the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, GoToGoCar has designated a Grievance Officer for India:
